Creative business and leasing structures and supportive legislation have generated increased interest by developers in leasing private and public property for solar projects. Solar projects provide revenue opportunities for property owners. Projects are developed on commercial rooftops, bodies of water, parking lots, and vacant tracts of land.

Critical issues in structuring and negotiating solar leases include type of agreement, lease payments, lease structure and term, mineral and other third-party interests, insurance, maintenance, repairs, access, system removal and restoration, and lender rights.
