Estate planning should be undertaken by every person and failure to do so will subject an estate to probate proceedings under state laws. It's essential for attorneys to have a firm understanding of common trusts and estate planning documents and the nuances of various strategies to assist clients with their estate plan.

Attorneys assisting and guiding clients through the estate planning process must understand various mechanisms for passing assets to beneficiaries at death and how to plan for incapacitation. Counsel must consider key provisions and challenges of wills and revocable trusts, various documents for setting up an estate plan and protecting assets, naming guardians, and potential traps that must be avoided.
