This CLE course will explain the 2021 ALTA/NSPS Standards and identify the recent, significant modifications. The panel will also discuss how title insurers typically address various survey matters in title policies and the utility of survey endorsements.
Faculty

Mr. Kent is a past-president of both ACSM and the Indiana Society of Professional Land Surveyors. He has a BS degree in Land Surveying from Purdue University and is registered to practice surveying in Indiana and Michigan. He has been chair of the joint ALTA/NSPS committee responsible for the ALTA/NSPS Land Title Survey standards since 1995. Schneider Geomatics is a consulting firm based in Indianapolis providing surveying, consulting engineering, and utility permitting/licensing services for railroad crossings.

Ms. Slade is the 2018-2019 Real Estate Committee Chair and 2017-2018 Chair of the Indiana State Bar Association's Probate Trust and Real Property Section of the Indiana State Bar Association. She has served as co-editor of that Sections newsletter as well as a co-editor of the Indiana Land Title Association Handbook. Her real estate career has also included private practice as a real estate transaction and litigation attorney and as regional underwriting and claims counsel and state underwriting counsel for two other national title underwriters for 16 states and the District of Columbia.
Description
Land surveys are primary due diligence tools in real estate transactions or development deals. They depict location, boundary, and topography, with a description of improvements, encumbrances, and other observations.
The new 2021 Minimum Standard Detail Requirements for ALTA/NSPS Land Title Surveys became effective on Feb. 23, 2021. Practitioners must understand the revised Standards (including Table A) to ensure surveys are correctly prepared.
Surveys can reveal significant title matters, which may appear as exceptions to title coverage. Counsel must address survey issues with the title company (and purchasers and lenders) and know which survey or other endorsements can resolve survey matters.
Listen as our authoritative panel reviews the revised ALTA/ACSM Land Title Survey Standards. The panel will look at the last set of changes from the 2011 Standards, including the revised Table A, emphasizing reviewing surveys from the perspective of title insurers.
